Methods of Collection
Only an attorney can use the legal system to collect the moneys owed to you. Why use a collection agency?
· Demand Letters: We promptly send the debtor letters demanding payment. This will let the debtor know that you have retained an attorney, and that you are serious about collecting your money. Also, a demand letter also allows us to determine if the debtor is still at the address that you have provided to us.
· Commencement of a Lawsuit: If the debtor refuses to pay, we will seek court intervention. Once a lawsuit is commenced, debtors often pay or attempt to settle the matter. You will have control over the terms of any settlement, or if we should commence a suit.
· Judgment: If we are unable to settle the case, we will prepare for trial. If we are successful at trial, a judgment will be entered in your favor for the amount due to you. Often a trial is not necessary and we can obtain a default judgment or summary judgment against the debtor.
· Post Judgment: Once a judgment is entered, we will use, among others things, the following to collect your money:
¨ Income Executions;
¨ Real Property Liens;
¨ Levy on Personal and Real Property;
¨ Restraining Notices; and
¨ Receivership.
